Civil Litigation / Consumer Protection
  • Negotiated numerous six and seven figure settlements for claims including medical malpractice, consumer protection, personal injury, business torts, lender liability, breach of contract, condemnation, bad faith insurance claims, and identity theft, as well as violations of federal and state statutes, including, but not limited to, the North Carolina Debt Collection Act, the North Carolina Unfair and Deceptive Trade Practices Act, the Homeowners Protection Act, the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Telephone Consumer Protection Act, and the Fair Credit Reporting Act.
  • Obtained $750,000.00 verdict in Columbus County related to a shooting.
  • Obtained the first jury verdict of record in North Carolina finding that a bank had violated the Equal Credit Opportunity Act, which case involved a multi-million dollar loan.
  • Obtained jury verdict against a bank for fraud and unfair and deceptive trade practices.
  • Obtained jury verdict in favor of a Raleigh businesswoman for malicious prosecution.
  • Obtained jury verdict in a New Hanover County condemnation case which was three times higher than the amount deposited by the North Carolina Department of Transportation (“NCDOT”).
  • Successfully defended at trial a collection action seeking hundreds of thousands of dollars in Robeson County Superior Court.
  • Obtained arbitration award against a crop insurance company for bad faith and treble damages in the amount of $660,000.00.
  • Obtained jury verdict in favor of client, a non-profit homeowners association in Fayetteville, North Carolina, against its former property management company after week-long jury trial in the United States Bankruptcy Court for the Eastern District of North Carolina.
  • Obtained award of sanctions against WakeMed d/b/a WakeMed Health & Hospitals for unauthorized disclosure of individual clients’ social security numbers and violations of Federal Rule of Bankruptcy Procedure 9037.
  • Obtained a settlement of $109,000.00, on behalf of subcontractor against general contractor, for breach of contract, relating to various residential development projects in Wake County, North Carolina.
  • Obtained settlement of $100,000.00 and cancellation of underlying mortgage obligation (approximately $88,000.00), on behalf of individual consumer clients, against their mortgage servicer, Nationstar Mortgage, LLC d/b/a Mr. Cooper, in action alleging violations of the Bankruptcy Code and various state and federal statutes.
  • Obtained confidential settlements on behalf of individual client, who was the victim of identity theft, against automobile dealership in Charlotte, North Carolina, JP Morgan Chase Bank, N.A., Equifax Information Services, LLC, Experian Information Solutions, Inc., and Trans Union, LLC, for violations of the North Carolina Debt Collection Act, the North Carolina Unfair and Deceptive Trade Practices Act, the Fair Credit Reporting Act, and the North Carolina Identity Theft Protection Act.
Bankruptcy
  • Obtained bankruptcy discharges for hundreds of individual consumer bankruptcy clients in bankruptcy case filed under Chapter 7 and Chapter 13 of the Bankruptcy Code.
  • Represented iconic barbeque restaurant in successful reorganization under Chapter 11 of the Bankruptcy Code.
  • Represented telecommunications provider located in Raleigh, North Carolina, in reorganizing and restructuring its business operations under Chapter 11 of the Bankruptcy Code.
  • Represented homeowners association located in Fayetteville, North Carolina, in reorganizing and restructuring its business operations under Chapter 11 of the Bankruptcy Code.
  • Represented thirteenth-generation family farm, based in Bertie County, North Carolina, facing foreclosures and repossessions, in successful reorganization under Chapter 11 of the Bankruptcy Code.
  • Represented third-generation family farm, based in Greene County, North Carolina, in successful reorganization of approximately $3,500,000.00 in secured and unsecured debt under Chapter 11 of the Bankruptcy Code.

  • Represented Onslow County general contractor in successful reorganization under Chapter 11 of the Bankruptcy Code and obtained early discharge, resulting in relief from over $2,000,000.00 of unsecured debt.
  • Represented medical supply company, based in Wilmington, North Carolina, in successful reorganization of its secured and unsecured debt, as well as a restructuring of its equity ownership.
  • Represented numerous creditors in bankruptcy cases, protecting their rights and providing results, including obtaining relief from the automatic stay, allowance of administrative expense claims on behalf of commercial landlords, and negotiating favorable plan treatment.
Non-Bankruptcy Workouts / Tax
  • Represented numerous clients in negotiated settlements and workouts of the claims of creditors, ranging from $10,000.00 to $50,000,000.00.
  • Represented non-profit church-affiliated school in successful non-bankruptcy workout and restructuring of payroll tax liabilities assessed by the North Carolina Department of Revenue exceeding $500,000.00.
  • Represented seafood restaurant in eastern North Carolina in successful non-bankruptcy workout and restructuring of payroll and sales and use tax liabilities assessed by the North Carolina Department of Revenue and the Internal Revenue Service exceeding $250,000.00.
  • Represented family farms throughout Eastern North Carolina, in successful non-bankruptcy workout and restructuring of agricultural trade debt, including amounts owed to various chemical and seed distributors.
  • Successfully petitioned, and received innocent spouse relief afforded under the Internal Revenue Code, on behalf of female taxpayer, and complete relief of tax liability of approximately $73,000.00 that was assessed by the Internal Revenue Service and the North Carolina Department of Revenue.
  • Obtained complete cancellation of $400,000.00 judgment against aerospace engineering firm through implementation of discounted and deferred payment plan with judgment creditor.
